The Case Against the New Censorship: Protecting Free Speech from Big Tech, Progressives, and Universities

a book by Alan Dershowitz

(our site's book review)

Alan Dershowitz Analyzes the Current Regressive War against Freedom of Speech Being Waged by Well-Meaning but Dangerous Censors

The Amazon blurb says that In The Case Against the New Censorship: Protecting Free Speech from Big Tech, Progressives, and Universities, Alan Dershowitz—New York Times bestselling author and one of America’s most respected legal scholars—analyzes the current regressive war against freedom of speech being waged by well-meaning but dangerous censors and proposes steps that can be taken to defend, reclaim, and strengthen freedom of speech and other basic liberties that are under attack.

Alan Dershowitz has been called “one of the most prominent and consistent defenders of civil liberties in America” by Politico and “the nation’s most peripatetic civil liberties lawyer and one of its most distinguished defenders of individual rights” by Newsweek. He is also a fair-minded and even-handed expert on the Constitution and our civil liberties, and in this book offers his knowledge and insight to help readers understand the war being waged against free speech by the ostensibly well-meaning forces seeking to constrain this basic right.

Anti-Trump Zealots Weaponized, Distorted, and Weakened Constitutional Protections in an Effort to “Get” Trump by Any Means

The Case Against the New Censorship: Protecting Free Speech from Big Tech, Progressives, and Universities is an analysis of every aspect of the current fight against freedom of speech, from the cancellations and deplatformings practiced by so-called progressives, to the powerful, seemingly arbitrary control exerted by Big Tech and social media companies, to the stifling of debate and controversial thinking at public and private universities. It assesses the role of the Trump presidency in energizing this backlash against basic liberties and puts it into a broader historical context as it examines how anti-Trump zealots weaponized, distorted, and weakened constitutional protections in an effort to “get” Trump by any means.

In the end, The Case Against the New Censorship: Protecting Free Speech from Big Tech, Progressives, and Universities represents an icon in American law and politics exploring the current rapidly changing attitudes toward the value of free speech and assessing potential ways to preserve our civil liberties. It is essential reading for anyone interested in or concerned about freedom of speech and the efforts to constrain it, the possible effects this could have on our society, and the significance of both freedom of speech and the battle against it in a greater historical and political context.

Reviews of The Case Against the New Censorship: Protecting Free Speech from Big Tech, Progressives, and Universities

"The Case Against the New Censorship: Protecting Free Speech from Big Tech, Progressives, and Universities is a book well worth reading and pondering."—Harvey Silverglate

“Alan Dershowitz speaks with great passion and personal courage.”—Eli Wiesel

“Alan Dershowitz is a living profile in courage.”—Steve Forbes

“Over [his] storied career, Dershowitz has remained more or less unchanged: loud, provocative, brilliant and principled.”—Politico

“The fearless, peerless Alan Dershowitz.”—Rabbi Lord Jonathan Sacks, Chief Rabbi, Great Britain

“The truth has no greater defender than Alan Dershowitz.”—Benjamin Netanyahu

“There are great legal minds; there are those who can also communicate well on television; then there is Dershowitz. The professor is uniquely capable of arguing a position, while putting a premium on legal and ethical legitimacy, not its popularity. Bravo, Dershowitz!”—Chris Cuomo, Anchor and Reporter, Cnn

“Anyone interested in the true merits of criminal law and very fine writing must read Alan Dershowitz’s book.”—Truman Capote

“Love him or hate him, Dershowitz has lived a life that matters, hugely and enduringly. He is a man in full at a time when most of us aspire to be little more than a presence on Twitter.”—New York Times Book Review

“Courage and principle are rare today. Professor Dershowitz has them both.”—Senator Ted Cruz

"Alan Dershowitz's commitment to free speech, fundamental fairness, and an open culture of freedom of expression has made him the scourge of both censors and double standards. He understands deeply that those who seek to silence others, either through governmental acts or a revival of McCarthy-era blacklists, are removing the protections of liberty on which all of us depend for our future freedom."—Alan Charles Kors, Henry Charles Lea Professor Emeritus of History, University of Pennsylvania

Ceding to the government the power to censor 'bad' speech will quickly devolve into censorship of all speech those in power disagree with, destroying democracy as we know it
Ceding to the government the power to censor 'bad' speech will quickly devolve into censorship of all speech those in power disagree with, destroying democracy as we know it

"Alan Dershowitz has been the most prominent First Amendment absolutist since the death of Justice Hugo Black in 1971. Defending speech that he disagrees with, and speakers whose views he abhors, is for Dershowitz not just a theoretical construct; it is a life passion. He understands, as few do today, that ceding to the government the power to censor 'bad' speech will quickly devolve into censorship of all speech those in power disagree with, destroying democracy as we know it. This book is a timely warning from the last great defender of Free Speech in America that we are well on the way to that unhappy result. We ignore it at our peril."—Alex Kozinski, Chief Judge of the Ninth Circuit Emeritus (Retired)

Liberals' version of giving Trump free speech rights

Liberals Really Believed, As Did Some of the McCarthyites of the 1950s, That Giving Free Speech Rights to Those Who They Feared Would Bring About Catastrophe

These modern day McCarthyites of the left were genuinely afraid of Donald Trump and what he stood for—as Eric Cartman of South Park would say: 'You will respect my authoritah!'

As Dershowitz says, "Now that I see good and decent people demanding censorship and denial of due process for those who collaborated with Trump, I have a better understanding of what I grew up with. These modern day McCarthyites of the left were genuinely afraid of Donald Trump and what he stood for. They really believed, as did some of the McCarthyites I knew during the 1950s, that giving free speech rights to those who they feared would bring about catastrophe. For them, both then and now, the noble end of preventing the victory of Communism or Trumpism justified any means, including the most ignoble or repressive.

"I recall being asked by some supporters of McCarthyism at Brooklyn College how I could defend the rights of Communists, who, if they came to power, would deny me my rights of free speech. I was asked similar questions by friends who saw my support for President Trump’s constitutional rights as enabling a president who would deny those basic rights to others. The similarities are striking and frightening. The essence of democracy is assuring rights even to those who would deny them to you. The Constitution is not a suicide pact, but nor is it a license to deny liberty in response to any perceived threat to safety.

The left wants control, but the Constitution allows too many freedoms, so liberals do everything they can to abolish our rights so they can push their Marxist agenda down our throats

"As Benjamin Franklin cautioned: “Those who would give up essential liberty to purchase a little temporary safety, deserve neither liberty nor safety.” We must sometimes compromise safety in the short-term to protect liberty in the long term. In extreme situations, we may even have to compromise some liberties in order to protect ourselves. But freedom of speech—freedom to criticize governments and other institutions—should never be among them."

Our Leftist Government and Universities Have Prevented Honest Discussions of Issues in Favor of Indoctrinating Students

The potential for Trump to deny freedom pf speech may exist, but it is minimal compared to the current reality of our leftist government and universities. The latter have prevented honest discussions of issues in favor of indoctrinating students—whether they like it or not—with ugly racist CRT theory, anti-conservatism, and anti-Americanism. Like fascists everywhere, they are happy to deny anyone's freedom of speech if it serves their purposes.

From 2016 until 2022, our media, FBI, the Deep State, and the Democrats perpetrated a massive attempted coup effort on Trump, the core of which was a fraudulent conspiracy by Hillary and her accomplices to use a whole system of lies and liberal propaganda to frame Trump on shameless bogus charges and lies so that he could be thrown out. When this failed, the desperate liberals tried impeachments, which also failed. The current January 6th committee witch hunt is simply one last desperate attempt by leftists to screw him over so he cannot run in 2024. If there was justice, it would be leftist liars who would be barred from running in 2024 and Hillary would be in jail. Massive fraud and conspiracy used to be illegal, but our crooked justice system lets it slide if it's leftist crime, but not rightwing crime.

Our Leftist Government and Universities Have the Motto "Free Speech for Me, but Not for Thee"

The author frequently reminds us of the outlook by many—"Free speech for me, but not for thee." As the current mood in the country demonstrates, it is a struggle for people to recognize that free speech not only applies to what they want to say, but also to those who hold the opposite views. Alan Dershowitz accurately points out the many roadblocks that are preventing the free speech we used to enjoy in this country. Along the way, he manages to demonstrate that he is naive enough to buy into many leftist positions.

Biden came along and destructively reversed all of Trump's remarkable progress like a 2-year-old having a tantrum, and everything in the country went to hell
Biden came along and destructively reversed all of Trump's remarkable progress like a 2-year-old having a tantrum, and everything in the country went to hell

Trump fixed many of the things Obama broke or warped about the USA, fixing the economy, jobs, the border and its wall, ICE, foreign affairs and civil rights in college. Biden came along and destructively reversed all of Trump's remarkable progress like a 2-year-old having a tantrum, and everything in the country went to hell, making Biden the least popular president in history as many disgusted Democrats became Republicans. There are statements in the book that are offered as fact that are actually untrue liberal media talking points. As the author points out, free speech is free speech, even if a fact-check shows that the statements are not factual. Liberals won’t even see or hear these statements and conservatives will feel their blood begin to boil. The author reveals his true liberal colors disappointingly often. He seems too smart to buy into their lies, but, sadly, he isn't.

"The focus of this book remains the dangers posed to constitutional liberty when colleges and universities and their faculty and students, the news media, and progressive politicians and their supporters and enablers in the private sector, gang up in order to attack a political figure they disapprove of without adequate attention paid to constitutional rights and political norms."
